An independent judicial power is expected to be able to exercise control over the quality of regulations under the law which are legislative and executive products. However, a guarantee of the independence of this institution absolutely needs to be followed up with a transparent and accountable regulation testing process.Various laws that regulate the authority of the Supreme Court to test regulations under the law do not regulate much about the procedural law for examining applications for testing regulations under the law. The law delegates the regulation of procedural law in the form of a Supreme Court Regulation.Currently, the procedural law for testing regulations under the law is regulated in Perma Number 1 of 2011 concerning Material Review Rights. The Perma does not regulate the process of examining applications for testing regulations openly and involving the parties.A thorough reform is needed regarding the authority of the Supreme Court in administering Material Review Rights. The Coordinating Ministry for Legal Affairs, Human Rights, Immigration and Corrections, the Supreme Court, Bappenas, and related institutions need to further study the revision of the Perma, so that it can streamline the implementation of the authority to test regulations under the law as a form of control over legislative and executive power in forming regulations.The opinion above is the personal view of Nicholas Martua Siagian based on academic studies, field reviews, and experience, and does not represent any state institution.Perlu reformasi menyeluruh terhadap kewenangan Mahkamah Agung dalam menyelenggarakan Hak Uji Materiil.
