2024 Election Controversy: PHPU Lawsuit and Political Speculation After the Constitutional Court Decision

The 2024 Election is one of the most controversial elections in the history of Indonesian constitutional law. Various cases arose accompanying the dynamics of the 2024 election process. Starting from the preparation to after the issuance of the KPU decree (regarding the number of election vote recapitulations) which broke various regulations. KPU Decree Number 360 of 2024, shows the number of recapitulation votes for candidate pair number 2, namely, Prabowo Subianto and Gibran Rakabuming Raka, outperforming candidate pair number 1 & 3. By reaching approximately 96 million votes. The birth of the decree was immediately responded to with various PHPU lawsuits to the Constitutional Court (MK) over various allegations, one of which was the alleged abuse of power by President Jokowi in the presidential election, especially during the lame duck period.

The Constitutional Court's decision regarding the PHPU was issued, stating that the judges rejected the exceptions submitted by the Respondent and the Related Party, stating that the Constitutional Court was not authorized to handle the 2024 Presidential Election PHPU case. This signifies the completion of the alleged fraud in the 2024 Election. However, in fact, after the Constitutional Court's decision was issued, it did not stop all the issues and chaos in Indonesia. The country is actually busy with narratives and tactical plans that are considered to violate various laws and regulations. Such as the government's plan to revise several regulations such as the Constitutional Court Law, Broadcasting Law, State Ministry Law, TNI Law and Polri Law. The massive government in the final days (lame duck) raises various speculations about the president's relationship with the next elected leader. It is even considered closely related to political reciprocity.
