Consumer Rights Skincare
Consumers are every person who uses goods and services available in society, both for their own interests, family, other people, as well as other living things and not for trading.
In this case, consumers have several rights that have been stated in Article 4 of Law Number 8 of 1999 concerning Consumer Protection, namely:
- The right to comfort, security, and safety in consuming goods and/or services
- The right to choose goods and/or services and to obtain these goods and/or services in accordance with the exchange value and conditions and guarantees promised
- The right to correct, clear, and honest information regarding the condition and guarantees of goods and/or services
- The right to be heard regarding opinions and complaints about goods and/or services used
- The right to obtain advocacy, protection, and appropriate consumer protection dispute resolution efforts
- The right to receive consumer education and guidance
- The right to be treated or served correctly, honestly, and without discrimination
- The right to obtain compensation, indemnity, and/or replacement if the goods and/or services received do not conform to the agreement or are not as they should be
- Rights regulated in other statutory regulations.
Obligations of Business Actors
Before discussing legal protection for consumers, it is necessary to know the obligations of business actors in Article 7 of Law Number 8 of 1999 concerning Consumer Protection, namely:
- Acting in good faith in carrying out their business activities
- Providing true, clear, and honest information regarding the condition and guarantees of goods and/or services, as well as providing explanations for use, repair, and maintenance
- Treating or serving consumers correctly, honestly, and without discrimination
- Guaranteeing the quality of goods and/or services produced and/or traded based on the prevailing quality standard provisions for goods and/or services
- Providing opportunities for consumers to test and/or try certain goods and/or services, as well as providing guarantees and/or warranties on goods made and/or traded
- Providing compensation, indemnity, and/or replacement for losses due to the use, application, and utilization of traded goods and/or services
- Providing compensation, indemnity, and/or replacement if the goods and/or services received or utilized do not conform to the agreement.
As for several things that business actors are prohibited from doing, they have also been regulated in Article 8 paragraph (1) letters (d) and (f) of the Consumer Protection Law, namely business actors are prohibited from producing and/or trading goods and/or services that:
d. do not conform to the condition, guarantee, privilege, or efficacy as stated in the label, tag, or information of the goods and/or services
e. do not conform to the promise stated in the label, tag, information, advertisement, or sales promotion of the goods and/or services.
In addition, it is also regulated in Article 9 paragraph (1) letters j and k of the Consumer Protection Law, namely business actors are prohibited from offering, promoting, advertising goods and/or services incorrectly, and/or as if:
j. using excessive words, such as safe, harmless, containing no risks or side effects without complete information
k. offering something that contains uncertain promises.
