Legal Literacy - Criminal Law Science is knowledge about criminal law that applies in a country. In this science, there are three phases to understand objectively criminal law, namely interpretation, construction, and systematic. By understanding this, we can determine the law objectively and avoid subjective views.

Criminal Law Science

Criminal Law Science is the science or knowledge of a specific part of law, namely criminal law. The object of this science is the rules of criminal law that apply in a country; for us, Indonesian criminal law, the applicable criminal law is called positive criminal law. In Indonesia itself, the provisions regarding criminal law are divided into 2, namely the legal rules contained in the Criminal Code or Wetboek van Strafrecht, and criminal provisions outside the Criminal Code.

Then the question arises, what is the purpose of science criminal law? the aim is to investigate the objective meaning of positive criminal law. In an objective sense, positive criminal law can be interpreted as a series of prohibitions or obligations to do something, which violators are subject to the threat of punishment. “Rechtswissenschaft ist die Wissenschaft vom obyektiven sinn des positive Rechts”, said Prof. Radbruch in Vorschule der Rechtfilosofie 1948.

The investigation has 3 (three) phases to go through, three Stufen, namely:

  1. Interpretation;
  2. Construction;
  3. Systematic.
