Two Traditions of the Rule of Law

There are two major traditions of the rule of law idea in the world, namely:
  • The Rule of Law in the Continental European tradition, called Rechtsstaat. In this tradition, the rule of law is characterized by the recognition of human rights, separation of powers, government based on law, and administrative justice.
  • The Rule of Law in the Anglo-Saxon tradition, called the Rule of Law. In this tradition, the rule of law is characterized by the supremacy of law, equality before the law, and a constitution based on human rights.

Elements of the Rule of Law

The following are the elements of the rule of law in both traditions:

Human rights

Human rights are fundamental rights inherent in every person, cannot be revoked, and must be protected by law. Human rights are an element important in the rule of law because it functions as a limitation on state power over individuals.

Separation of powers

Separation of powers is the division state power into three branches, namely legislative, executive, and judicial. The separation of powers functions to prevent abuse of power by one branch of power.

Government based on law

Governance based on the rule of law means that the government must act in accordance with applicable laws and regulations. This serves to ensure that the government does not act arbitrarily.

Administrative justice

Administrative justice is a court authorized to examine and decide disputes involving the government. Administrative justice serves to ensure that the government acts in accordance with the law.

Supremacy of the law

Supremacy of the law means that the law is supreme, not the power of man. This means that everyone, including the government, must be subject to the law.

Equality before the law

Equality before the law means that all people, regardless of social status, position, or background, must be treated equally before the law.

A constitution based on human rights

Independent Judicial Power
