Responding to this ridiculous event, once again, the District Court does not have the authority and capacity to decide whether to continue or postpone the election. Because juridically there is no umbrella law that facilitates the District Court to act in this way. After all, the constitution has mandated that elections must be held every five years.
Pulling Up Roots, Looking for a Way Out
It has become a fixed price for the KPU as the defendant to make an effort legal appeal against the court decision that has been handed down by the Central Jakarta District Court. Because the implementation of elections does not only concern the interests of the parties in dispute, there are also other parties who are far more affected, namely the community.
In addition, this problem must not only be resolved by the KPU through its legal efforts. We are still waiting for what role the Supreme Court and the Judicial Commission will take in responding to this polemic. The root of the problem does not only arise from the substance of the court's decision which is considered odd, but also this event cannot be separated from the motives that are always the most important thing and often disturb the public's curiosity in uncovering an actual event.
Therefore, the gavel that has been struck by the panel of judges and the order to postpone the election that has been stated in the decision letter cannot be taken lightly and ignored. The election implementation process is not an annual carnival or a pseudo-democracy party that is merely a formality. More essential than that, the implementation of elections is a process of transition and rotation of power and a solid tool to dismantle the symptoms of absolutism of power. In short, the certainty to hold elections as scheduled must be implemented. Because only in this way can the process of circulation and the democratic ecosystem continue to grow, be healthy and well maintained.
