Legal Literacy - An apprenticeship is a learning activity, especially for students who want to gain experience and insight into the world of work. Usually, an apprenticeship program is required by the university with certain conditions depending on the university's regulations. In addition, there are also students who want to gain apprenticeship experience without having to follow university regulations. Thus, it is known that there are Rights and Obligations of Apprentices.
For students, the existence of an apprenticeship program will certainly be very beneficial. They can improve both their soft skills and hard skills that they gain during the apprenticeship program.
Then, will participants who are undergoing an apprenticeship process receive a salary?
According to the Instagram account of the Ministry of Manpower on July 29, 2022, interns do not receive a salary but rather an allowance. According to Article 13 of the Regulation of the Minister of Manpower Number 6 of 2020 concerning the Implementation of Apprenticeships in the Country, interns must receive adequate facilities, receive their rights, an allowance, and obtain an apprenticeship certificate.
The allowance received by interns includes food money, transportation, and incentive money during the apprenticeship program.
What are the working hours for apprentices?
Working hours for interns must not be outside of operational working hours and on official holidays. In addition, for interns on night shifts according to Article 18 of the Regulation of the Minister of Manpower Number 6 of 2020 as follows:
- The minimum age of Apprenticeship participants is 18 (eighteen) years;
- Provide shuttle transportation;
- Provide food that meets the specified nutritional standards; and
- In accordance with the type of competence required.
What are the requirements to participate in an apprenticeship program?
In addition, Apprenticeship Participants as referred to must meet the following requirements:
- Minimum age of 17 (seventeen) years for job seekers
- Physically and mentally healthy; and
- Pass the selection.
Participants who are still 17 years old must obtain approval from parents or guardians.
The maximum period for completing an internship is 1 year from the signing of the participant to start the internship. If there is no written signature/agreement, the participant is not an intern but an employee/laborer in the company.
The Apprenticeship Agreement must contain:
- Rights and obligations of the Apprenticeship participant;
- Rights and obligations of the Apprenticeship Organizer;
- Apprenticeship Program;
- Apprenticeship period; and
- The amount of pocket money.
Therefore, companies that provide places for internships/apprentices must follow the existing procedures. If they do not follow these procedures, it is certain that the company has violated the law. That is a brief explanation regarding the rights and obligations of internship participants.
