Traffic accidents are one of the events that can cause material and immaterial losses. Material losses can be in the form of vehicle damage, property damage, and medical expenses. Immaterial losses can be in the form of pain, suffering, and disability. If you experience a traffic accident, you have the right to claim compensation from the party responsible for the accident. Compensation can be in the form of reimbursement for material and immaterial losses that you experience.

How to Claim Traffic Accident Compensation

There are two ways to claim compensation for traffic accidents, namely through civil law andcriminal law.

Civil Law Route

If you want to claim compensation throughcivil law, you can file a lawsuit in court. The lawsuit must contain the following elements:
  • Subject element, namely the identity of the plaintiff and defendant.
  • Object element, namely the traffic accident and the losses suffered by the plaintiff.
  • Reason element, namely the legal basis for the compensation claim.
In the lawsuit, you must include evidence to support your claim. The evidence can be in the form of:
  1. Visum et repertum letter from a doctor.
  2. Photos or videos of the traffic accident.
  3. Proof of damage to vehicles or property.
  4. Proof of medical expenses.
