Violation Act

  1. Failure to provide rights Protection against workers, failure to pay wages, violation of the law against workers who have the right to strike will be subject to a criminal sanction of imprisonment for a minimum of 1 (one) month and a maximum of 4 (four) years and/or a fine of a minimum of Rp 10,000,000.00 (ten million rupiah) and a maximum of Rp 400,000,000.00 (four hundred million rupiah).
  2. Not having a written permit, not complying with the provisions if employing foreigners, not meeting the requirements in production activities, not meeting the requirements for children (apprentices), failure to pay overtime to workers, failure to provide leave/rest, failure to pay workers who work on official holidays, and violation of the provisions regarding strikes by workers will be subject to a criminal sanction of imprisonment for a minimum of 1 (one) month and a maximum of 12 (twelve) months and/or a fine of a minimum of Rp 10,000,000.00 (ten million rupiah) and a maximum of Rp 100,000,000.00 (one hundred million rupiah).
  3. Not having a permit to the manpower agency in the city/regency, collecting fees other than for labor placement from labor users and from workers in certain groups and positions, violating PKWTT (Fixed-Term Employment Agreement), not meeting the criteria for overtime work, not creating company regulations (if employing at least 10 people), not renewing company regulations (at the latest 2 years after the regulations are ratified), and not providing clarity on company regulations to workers will be subject to a criminal sanction of a fine of a minimum of Rp 5,000,000.00 (five million rupiah) and a maximum of Rp 50,000,000.00 (fifty million rupiah).
