Important Things to Know

1. Time of Filing the Application

The derden verzet application must be filed within 14 days of the third party becoming aware of the court decision that harms their rights. If the deadline is exceeded, the application will not be accepted by the court.

2. Required Evidence

Third parties filing a derden verzet must include evidence demonstrating their rights to the object or right that is the subject of the case. Such evidence may include ownership certificates, power of attorney, or other documents showing that the third party has rights to the object or right that is the subject of the case.

3. Costs

As with other civil cases, this effort requires costs to finance lawyers and administration of filing the application. Third parties must prepare the necessary costs in the submission.

4. Lawyer

Although not required, it is advisable for third parties to file a derden verzet accompanied by a lawyer experienced in civil law. A lawyer can help the third party to develop strong arguments and evidence to obtain a favorable decision.

5. Decision Results

If the application is accepted, the court will issue a new decision that considers the rights of the third party to the object or right that is the subject of the case. However, if the application is rejected, the third party will not have rights to the object or right that is the subject of the case.
