In terms of legal protection of Trademark and Geographical Indications for regional handicrafts in Article 69 paragraph (1) that “The Right Holder of a Geographical Indication may file a lawsuit against an Unauthorized User of a Geographical Indication in the form of a request for compensation and termination of use and destruction of Geographical Indication labels used without authorization”.
In the elements of Article 69 paragraph (1) of Law Number 20 of 2016 concerning Trademarks and Geographical Indications that the ability of business actors to develop product and service innovations makes business competition a reasonable condition or situation to create the development and expansion of the business being managed. Indirectly, the unique regional handicrafts need to be given a differentiator through trademark registration for the geographical products of a region so as to provide legality both nationally and internationally.
What is the Regional Economic Impact after the Work is Legally Registered?
The uniqueness of a region can create new value as value through differentiation of the work. In Article 1 number 4 Law Number 20 of 2016 concerning Trademarks and Geographical Indications that "A collective mark is a Mark used on goods and/or services with the same characteristics regarding the nature, general characteristics, and quality of the goods or services and their supervision which will be traded by several people or legal entities jointly to distinguish them from other similar goods and/or services”.
That way, when business actors will try to create, package and market the products they have, whether goods or services, as well as possible so that they are in demand and bought by consumers.
As in the case of songket cloth originating from Silungkang from West Sumatra Province with Number G002019000001 has been registered since the protection began in 2018. The role of the Regional Government and the Central Government has succeeded in encouraging the registration of Silungkang community handicrafts in Sawahlunto in the form of songket cloth and has become global to this day. Of course, this will create positive implications in the form of capital investment from abroad (foreign) to regions that have legal certainty and strong regulations as the trust of investors to invest in the region.
Through the Sawahlunto Mayor's Decree Number 188.45/37/WAKO-SWL/2019 concerning the Determination of the Management of the Silungkang Songket Geographical Indication Protection Community, the legal protection of the Geographical Indication for Silungkang songket cloth has been guaranteed by forming the Management of the Silungkang Songket Geographical Indication Community.
