Legal Literacy - Internships are a learning activity, especially for students who want to gain experience and insight into the world of work. Usually, internship programs are required by universities with certain conditions depending on university regulations. In addition, there are also students who want to gain internship experience without having to follow university regulations. Thus, it is known that there are Rights and Obligations of Interns.

For students, the existence of an internship program will certainly be very useful. They can improve both their soft skills and hard skills that they acquire during the internship program.

So, will participants who are undergoing the internship process receive a salary?

Reported from the Instagram account of the Ministry of Manpower on July 29, 2022, that interns do not receive a salary but rather an allowance. According to Article 13 of the Regulation of the Minister of Manpower Number 6 of 2020 concerning the Implementation of Apprenticeships in the Country, interns must receive adequate facilities, receive their rights, allowances, and obtain an internship certificate.

The allowance received by interns is in the form of meal money, transportation, and incentive money during the internship program.

What are the working hours for interns?

Working hours for interns must not be outside of working operational hours and on official holidays. In addition, for interns on night shifts according to Article 18 Regulation of the Minister of Manpower Number 6 of 2020 as follows:

  1. The minimum age of the Apprenticeship participant is 18 (eighteen) years;
  2. Provide shuttle transportation;
  3. Provide food that meets the specified nutritional standards; and
  4. In accordance with the type of competence required.

What are the requirements to participate in an internship program?

In addition, Apprenticeship Participants as referred to must meet the following requirements:

  1. Minimum age of 17 (seventeen) years for job seekers
  2. Physically and mentally healthy; and
  3. Pass the selection.

Participants who are still 17 years old must obtain approval from their parents or guardians.

The time limit for undergoing the internship period is a maximum of 1 year from the signing of the participant to start the internship. If there is no signature/written agreement, then the participant is not an intern but rather a worker/laborer in the company.

The Apprenticeship Agreement must contain:

  1. Rights and obligations of Apprenticeship participants;
  2. Rights and obligations of the Apprenticeship Organizer;
  3. Apprenticeship Program;
  4. Apprenticeship period; and
  5. Amount of allowance.

Therefore, companies that provide places for internships/apprentices must follow the existing procedures. If they do not follow, then it is certain that the company has violated the law. That is a little explanation regarding the rights and obligations of interns.
