Legal Literacy - This article explains the legal basis for the protection of the piracy of a well-known brand on certain products based on the existing positive law in Indonesia.
Definition of a Well-Known Brand
A well-known brand can be defined as a brand with high appeal that is capable of generating various suggestions of prestige and a good image of the brand in the eyes of the public. The prestige and good image that has arisen is what makes various products with well-known brand labels very popular in the market. This happens because in the current modern era, people's desire to buy a product is not only based on aspects of need alone, but also depends on the element of satisfaction and pride in the item. Goods labeled with well-known brands will reflect the quality and reputation they carry.
The criteria for classifying well-known brands have been specifically formulated through the Jurisprudence of the Supreme Court of the Republic of Indonesia No. 1486 K/PDT/1991 dated November 28, 1995. In the jurisprudence a quo, well-known brands or Well-Known Marks must first be able to penetrate the international market, meaning that when the brand is known in many countries, the brand automatically becomes a well-known brand.
