Legal Literacy - This article presents an analysis of crime from various perspectives, namely normative, sociological, and psychological, based on the viral case of an elderly woman named Minah who stole 3 cocoa pods and was sentenced to imprisonment. The normative perspective examines criminal behavior from the perspective of criminal law, the sociological perspective reviews the impact of crime on society, and the psychological perspective explores psychopathological factors that influence the perpetrator's actions. This article provides insights into the complexity of crime and the importance of maintaining justice in law enforcement.
In Criminology, crime can be viewed from different perspectives. These perspectives assessing crime can be applied to various cases. One case that went viral was the case of an elderly woman named Minah who stole 3 cocoa pods and was sentenced to imprisonment.
Crime from a normative perspective
Human behavior that can be considered a crime normatively is behavior that violates the rules criminal law. This refers to Article 1 of the Criminal Code, which states that no criminal act may be punished except by the force of criminal rules and laws that preceded the act. If the act is not regulated, it is not considered a crime. However, the so-called act of crime also causes harm to others and is also threatened by the state.
Based on the case that has been presented, namely an elderly woman who stole 3 cocoa pods, from a normative perspective, the behavior carried out by the elderly woman Minah is considered a crime. The reason is referring to Article 362 of the Criminal Code which states that "anyone who takes something that is wholly or partly the property of another, with the intention of unlawfully possessing it, is threatened with theft with a maximum imprisonment of five years and or a fine of a maximum of nine hundred rupiah".
Although the act committed by the elderly woman Minah was unintentional because she did not know that the cocoa taken was from someone else's garden, this is detrimental to the garden owner, where the social reaction that arises may be that if even the smallest act of theft is forgiven, other similar behaviors may arise to commit theft.
Basically, what the judge has done, namely a prison sentence of 1 month and 15 days with a probation period of 3 months, is to ensure that legal certainty is upheld in the life of the Indonesian state, which is a state of law (Article 1 paragraph 3 of the 1945 Constitution of the Republic of Indonesia), that the law does provide justice for all people without discrimination. Regardless of the appropriate or inappropriate value, good or bad value or perspective given to the public regarding the prison sentence given to the elderly woman Minah. The crime committed by the elderly woman Minah may be a minor crime, but because crime violates legal norms, the sanctions for the crime must still be carried out.
