Objective Rule of Law

The following are the objectives of rule of law:

  1. Creating and maintaining fair treatment for all individuals in society.
  2. Preventing the government and public officials from abusing power.
  3. Protecting individual freedoms of opinion, religion, speech, and movement.
  4. Creating a stable and reliable legal environment to reduce conflict.
  5. Supporting economic growth by providing protection for property rights and contracts.
  6. Ensuring the protection of human rights, including the right to recognition, guarantees, protection, and fair legal certainty.
  7. Encouraging public awareness and compliance with the law.
  8. Ensuring that the state is under the law and not above the law.
  9. Helping to avoid social conflicts by creating a clear legal framework.
  10. Serving as the foundation for good, transparent, and accountable governance.

Fundamental Element in Rule of Law

Albert Venn Dicey in Introduction to the Law of the Constitution, put forward the term rule of law which means an order in law.

According to him, there are 3 fundamental elements contained in the concept, namely:

  1. Supremacy of the rules of law.
  2. Equality before the law.
  3. Guaranteed Human Rights (Human Rights) by laws and court decisions.

Implementation Rule of Law in Indonesia

The following is the implementation rule of law in Indonesia:

  1. Courts in Indonesia must perform their functions independently without intervention from the executive or legislative branches.
  2. The Indonesian government must ensure social justice for all people through social assistance policies and increased access to education and healthcare.
  3. Indonesia has laws and legal instruments to protect human rights.
  4. Institutions such as the KPK were formed to oversee and prosecute acts of corruption.
  5. Property law provides protection for ownership rights.
  6. Citizens have the right to form civil organizations in accordance with the law.
