JAKARTA, Legal Literacy - The Selection Committee (Pansel) for constitutional judge candidates from the Supreme Court has passed 10 names in the administrative selection to fill the position of constitutional judge replacing Anwar Usman. The Pansel targets the entire selection process to be completed by early March 2026, considering Anwar Usman's term of office will end on April 6, 2026, after serving for 15 years.

Anwar Usman was first inaugurated as a constitutional judge on April 6, 2011. In accordance with the rules regarding the term of office of constitutional judges, he will end his duties because he has reached the maximum term of service, which is 15 years.

Next stage: public input, written test, then interview

The head of the Pansel, Suharto, confirmed that the results of the administrative selection have been announced. Furthermore, the Pansel is opening opportunities for the public to provide opinions or input regarding the candidates through the MA supervision channel. Acceptance of input from the public is scheduled until February 23, 2026.

After receiving input from the public, the selection committee (Pansel) scheduled:

  • Written exam: March 2–3, 2026
  • Interview: March 4–5, 2026
  • The announcement of the final results will be made on March 9, 2026.

Dynamics in the Constitutional Court: replacement seat Arief Hidayat and highlights of the DPR process

On the other hand, the Constitutional Court (MK) has just released Arief Hidayat, who entered retirement on February 3, 2026, after reaching the age of 70. The spokesperson for the Constitutional Court, Enny Nurbaningsih, stated that the trial will continue because decisions can be taken with a minimum of seven judges.

To fill the seat left by Arief from the DPR RI proposal, the DPR has appointed Adies Kadir, while also canceling the previous decision that had appointed Inosentius Samsul. President Prabowo Subianto is reported to have signed the Presidential Decree for his appointment, but the schedule for the oath-taking has not yet been announced.

The DPR's decision has drawn criticism, especially because the process is considered rushed and the background of Adies' ethical polemic (which was later declared not proven to be a violation by the Honorary Council). Jimly Asshiddiqie, the first former Chief Justice of the Constitutional Court, also expressed concerns regarding the practice of selecting constitutional judges and alluded to past experiences, including the Aswanto recall case which was then replaced by M. Guntur Hamzah.
