JAKARTA, Legal Literacy – The Candidate Pair for Regent and Vice Regent of Dogiyai Regency Number 04, Alfred Fredy Anouw and Orgenes Kotoki, are suing the decision of the General Election Commission (KPU) of Dogiyai Regency Number 701 of 2024 concerning the determination of the results of the Election of Regent and Vice Regent of Dogiyai Regency of 2024. The lawsuit was filed to the Constitutional Court (MK) with a preliminary examination hearing led by the Chief Justice of the Constitutional Court Suhartoyo together with Constitutional Justices Daniel Yusmic P. Foekh and M. Guntur Hamzah on Thursday (1/16/2025).
Disputed Vote Difference
In Case Number 178/PHPU.BUP-XXIII/2025, the Applicant's legal counsel, Theodora Amfotis, explained the difference in votes between the KPU data and the Applicant. Based on KPU data, Candidate Pair Number 01 Ruben Magai–Mateus Douw obtained 7,944 votes, Number 02 Yudas Tebai–Yuliten Anauw received 41,900 votes, Number 03 Otopianus P. Tebai–Angkian Goo obtained 9,618 votes, Number 04 Alfred Fredy Anouw–Orgenes Kotoki (Applicant) obtained 23,407 votes, Number 05 Freny Anouw–Abni Auwe received 2,292 votes, and Number 06 Oskar Makai–Yani Bobi obtained 10,919 votes. The total valid votes recorded were 98,080.
However, according to the Applicant, Candidate Pair Number 02 only obtained 31,900 votes, while they should have obtained 33,407 votes.
Allegation of Election Process Inconsistencies
Theodora stated that the difference in votes occurred due to miscalculations at the PPK level and a number of administrative violations. One example occurred in Mafia District, where the recapitulation from the DPP was sent late to the KPU until 04.00 WIT, past the deadline of 24.00 WIT. In addition, a number of votes from the villages were not counted in the plenary meeting in the district, but directly in the PPD.
The noken system implemented in Dogiyai Regency was also highlighted. Voting based on vote ties that should have been counted at the TPS was instead carried out at the PPD. In fact, election logistics were reported not to have reached the TPS or KPP. The Applicant's witness also revealed that the success team of Candidate Pair Number 02 allegedly forcibly took election logistics and sent them to the KPU, not through official officers.
Applicant's Demands
The Applicant requests the Constitutional Court to order the KPU of Dogiyai Regency to conduct a recount in KKP Kamu Utara, specifically for vote ties in Yametadi Village, and to ensure the return of the Applicant's votes allegedly taken by Candidate Pair Number 02. In addition, the Applicant requests Bawaslu of Dogiyai Regency to strictly supervise the recount process.
This case has become an important highlight regarding the implementation of elections in areas with the noken system, which requires strict supervision to ensure transparency and fairness.
